I am from U.S. and my first queston is > will there ever be any monkey videos in U.S? If so how can I > get them? Hi. It's not possible to buy Monkey on video anywhere in the world. In those countries where it has been shown on tv (e.g. UK, Australia, New Zealand), and it could be a long time before it will be available on video in these countries, that's if it ever will be available to buy on video (there's been years of negotiations that have so far come to nothing). So, in answer to your question, I would say that since Monkey has never been shown on tv in the US, and it's never been available on video even in the countries where it has been shown, the chances of it ever becoming available to buy on video in the US are very slim. The only way you can get episodes is to find someone who has episodes taped from tv, and is willing to make copies for you on a strictly non-profit basis; it's ok for you to cover their costs, but to pay them any more is illegal, as they're not allowed to make a profit from someone else's copyrighted work. Let's get this whole taping stuff on TV thing sorted once and for all. It is *NOT* legal to record television shows for your own use, period. (My, wot a handy Amercanism). There are no special exceptions (except a couple of very tight guidelines concerning research and study, and live performance rules which are almost impossible to meet anyway). Many people confuse the findings of the infamous Sony Corp vs Universal Studios (or 'Betamax') case, which found that off-air recording of a television broadcast did not violate the *broadcaster's* copyright as a license to record whatever the hell they wanted, whenever they wanted, regardless of the fact they they were violating a squillion other copyrights. US legal rulings on copying music recordings for personal use as 'fair use' of the material also confuse the issue. Here's the Australian case (and note that it's the same for any other country that signed the Berne Convention, the Universal Copyright Convention, or any of the other lesser copyright agreements, ie all of them) from copyright.org.au: _____________________________________________________________________ In a television program, the following elements are usually protected by copyright: - the script or screenplay; - each piece of music on the soundtrack; and - the moving images and sounds. For the purposes of copyright, most material shown on television contains these protected elements - whether feature film, serial, news program, current affairs, sports program or advertisement. When we refer to "television program" in this information sheet, we mean to include all of these. In some cases, there may be other copyrights as well - for example, if a program includes a photograph, or a dance sequence, or someone reading a poem. In addition, the broadcaster has a copyright in the broadcast. There is no exception which allows you to tape television programs for private use - for example, to watch a program at a more convenient time, or to watch a program again, or to give the tape to your friends to watch. There is a very limited exception which means that you do not infringe copyright in the broadcaster's copyright by taping for private use. However, there are nearly always other copyrights to consider - including the copyright in the moving images and sounds, the copyright in the script or screenplay, and the copyright in the music. This means that the only cases in which you may tape a program for private use without infringing copyright is where the broadcast is live (that is, it has not at any stage been "fixed" on film or video), and you do not record script or music or any other protected material which has been previously written down or recorded. This includes commercials which may be shown during the broadcast. Copying part of a television program will in most cases infringe copyright, unless a special exception applies. This is so even if the part you want to copy is a small proportion of the whole program. ___________________________________________________________________________ Please folks - if you're going to copy/trade tapes, so be it. But let's stop pretending that it's somehow 'more right' or 'more legal' than selling tapes - it isn't. We're criminals, pure and simple. Sort out right and wrong for yourself.
